BG: GLOBUL sends public procurement inquiries to 300 institutions
GLOBUL sent public information access requests to 300 Bulgarian government and municipal institutions regarding their choice of mobile and fixed services provider.
GLOBUL requested ministries, municipalities, government executive agencies to provide information on the public procurement procedures for mobile and fixed services in the last 5 years, the legal grounds for selection of the present providers and on the terms and conditions of the existing contracts. The request for information is based on Article 24, Paragraph 1 of the Access to Public Information Act.
The inquiries aim to establish whether the conducted public procurements for telecommunication services correspond to the requirements for transparency, equality and encouraging of competition as stipulated by the law. GLOBUL believes that at the moment these procedures in the majority of Bulgarian state and municipal administrations are not transparent enough.
Under the Access to Public Information Act, the institutions in question are obliged to respond to the inquiries within 14 days after registering the requests.
GLOBUL will inform the public about the results of the inquiries. If responses are not received in timely manner and in the appropriate way or if a violation of the public procurement procedures is discovered, the company will take all the necessary legal actions. The Law envisages fines of between BGN 50 and 100 for officials who do not respond to a request for access to public information in the indicated term without a justified reason.
The company hopes that this activity will result in a clear schedule for conducting mobile and fixed services tenders without imposing discriminative conditions.
